Problem solved. I was running out of virtual memory on the VPS server so the upgrade was not working correctly.

I got the notice today that there was a clamav upgrade. So I logged into 3 of my servers to perform the upgrade. 2 are fine. One the clamd service keeps failing. I have forced clamav update.
